Expert Criminal Defense Strategies

Nassau County Is Different

Nassau County borders the city, and the DA’s office treats it like a fortress. They want to send a message: crime that starts in NYC doesn’t end here. If you’re facing serious felony charges, understand this. They’ll prosecute you harder than almost anywhere in the country.

You need someone who knows the system. I can look at a case for ten minutes and tell you exactly what we’re dealing with. Negotiation or trial? Motion practice or sit tight? After 31 years, I don’t guess. I know.

The first few weeks after arrest? Critical. Decisions made then determine everything that follows. Call me immediately. (516) 280-2160.

31 Years in Nassau Courts

My first trial in Nassau was 1995. I’ve been walking these hallways ever since. I know which judges give you a fair shake. I know which prosecutors are bluffing. I know the court officers by name.

This isn’t book knowledge. It’s three decades of actual cases, actual wins, actual relationships. When your freedom’s on the line, that matters.

Where I Practice

Mineola (County Court)

Nassau County Court in Mineola handles the most serious cases — indicted felonies, violent crimes, major drug charges. The stakes don’t get higher. The DA assigns their best prosecutors here, and they don’t mess around.

You need someone who knows the courthouse inside out. I know the line assistants, the supervising ADAs, and what approach works with each judge. That knowledge comes from 31 years of showing up. Learn more about criminal defense in Mineola →

Hempstead (District Court)

Nassau County First District Court in Hempstead — 150 cases on the arraignment calendar. 30 to 100 cases per part. Three floors of courtrooms. It’s chaos if you don’t know your way around.

I do. I’ve been here since 1994. I know which judges handle what. I know the prosecutors. I know how to position a case for the best possible outcome. Learn more about criminal defense in Hempstead →

Long Beach City Court

City court, but same tough Nassau County DA. I know the judge here well, we graduated Hofstra Law together. That familiarity matters. Learn more about criminal defense in Long Beach →

What I Handle

Everything from misdemeanors to A-felonies:

Violent crimes: Assault, robbery, burglary, domestic violence, menacing. Nassau prosecutors pursue violent charges hard. Even a misdemeanor assault can carry real jail time here.

Drug offenses: Possession, sale, marijuana, prescription fraud. I know how to challenge unlawful stops, illegal searches, and chain-of-custody issues — often the difference between a conviction and a dismissal.

Theft: Grand larceny, petit larceny, embezzlement, shoplifting. Grand larceny starts at $1,000 in New York and escalates quickly. I’ve defended every degree of larceny charge in Nassau County courts.

Sex crimes: Assault, criminal sexual act, possession, registration issues. I have secured multiple Not Guilty verdicts on sex crime charges in Nassau County, including at the Mineola courthouse. These cases demand aggressive, experienced trial counsel.

Weapons: Criminal possession, firearms, illegal guns. Even a first offense can mean state prison time in Nassau. I’ve negotiated weapons charges down to misdemeanors and secured dismissals where constitutional violations occurred.

White collar: Fraud, forgery, identity theft, credit card fraud. Nassau County prosecutors pursue these with significant resources — and federal exposure in the Eastern District is always a possibility.

DWI cases: If you’re facing DWI charges in Nassau County, visit my dedicated Nassau County DWI lawyer page. Nassau prosecutes drunk driving more aggressively than anywhere else in New York State, and those cases require specialized knowledge of their unique procedures and the Katie Flynn legacy that shaped how DWI cases are handled here.

Misdemeanor or felony, I handle it.

The Reality of Nassau County

Nassau borders NYC. The DA’s office treats it like a wall. Violent crimes, guns, drugs, major theft, they throw the book at you. They have the resources and the political backing to pursue maximum penalties.

That’s why local experience matters. You need someone who gets the mindset, knows how to navigate it, and has the credibility to negotiate even in this environment.

After 31 years, I know what works here.

Penalties

Violation: 15 days, $250. Disorderly conduct, harassment.

Class B Misdemeanor: 3 months, $500. Simple assault, prostitution.

Class A Misdemeanor: 1 year, $1,000. Petit larceny, assault 3rd degree.

Class E Felony: 4 years, $5,000. Grand larceny 4th, assault 3rd.

Class D Felony: 7 years, $5,000. Burglary 3rd, robbery 3rd.

Class C Felony: 15 years, $15,000. Robbery 2nd.

Class B Felony: 25 years, $30,000. Robbery 1st, burglary 2nd.

Class A Felony: Life. Murder, major drug sale.

Felonies also mean fines, probation, restitution, and a permanent record that affects jobs, housing, licenses, and immigration.

Common Questions

Should I talk to police? No. Invoke your right to silence. Wait for your attorney.

What happens at arraignment? You’re charged, enter a plea, and bail gets decided. Have a lawyer there.

Can my case get dismissed? Yes. Insufficient evidence, illegal search, misconduct, successful motions. But Nassau is tough. You need experienced local counsel.

County vs District Court? County Court (Mineola): felonies, prison time. District Court (Hempstead): misdemeanors.

How long do cases take? Misdemeanors: months. Felonies: 6 months to over a year if trial.

Plea or trial? Depends on your case, evidence, history, and goals. I’ll analyze everything and give you my honest recommendation. Your call.

What if I’m innocent? You need aggressive representation even more. I’ll investigate, challenge evidence, interview witnesses, and fight to clear your name.

What does it cost? Misdemeanors: $2,500-$5,000. Serious felonies: $7,500-$25,000+. Free consultation.

Can I seal my record? Some convictions can be sealed after waiting periods. Some automatic. Serious felonies usually can’t. I’ll advise you.

Felony penalties? See the list above. They don’t mess around in Nassau County.

FREQUENTLY ASKED QUESTIONS

A: The Nassau County DA's Office is one of the most well-staffed and aggressive prosecutor's offices on Long Island. They handle everything from misdemeanors to serious felonies, and they have specialized bureaus for different types of crimes including domestic violence, narcotics, and major crimes. I've been dealing with Nassau County prosecutors for over 31 years. I know the assistant district attorneys, their supervisors, and how they approach different types of cases. That familiarity helps when it comes time to negotiate plea agreements or prepare for trial.

A: Your arraignment is your first court appearance after being arrested. The judge will read the charges against you, you'll enter a plea (usually not guilty), and the judge will set bail or release you on your own recognizance. In Nassau County, arraignments happen quickly—often within 24 hours of arrest. Having an attorney with you at arraignment is critical. I can argue for lower bail or release without bail, and I can start reviewing the prosecution's case immediately. Text me right away if you've been arrested: (631) 903-3733.

A: Yes, but it depends on the facts of your case. I've gotten cases dismissed in Nassau County through several methods: motions to dismiss based on speedy trial violations, trial verdicts, and through negotiated Adjournments in Contemplation of Dismissal (ACODs) where the case gets dismissed after six months if you stay out of trouble. Every case is different, but I always look for grounds to dismiss charges before we even consider plea negotiations.

A: An ACD (Adjournment in Contemplation of Dismissal) is an agreement where the prosecution puts your case on hold for six months. If you stay out of trouble during that time and meet certain conditions, the case is dismissed and sealed. ACDs are available in Nassau County for certain misdemeanors and violations, particularly for first-time offenders. I've negotiated ACDs for clients charged with petit larceny, marijuana possession, criminal mischief, and other offenses. An ACD means no criminal record and no conviction.

A: It depends on the charge and the court. Misdemeanor cases in Nassau District Court typically take 3-6 months from arraignment to resolution, though some resolve faster through early plea negotiations. Felony cases in Nassau County Court take longer—usually 6-12 months or more if the case goes to trial. The key is having an attorney who moves your case efficiently while still thoroughly investigating and preparing your defense. I know how to push cases forward when it benefits you and how to slow things down when we need more time to build your defense.

A: Misdemeanor convictions in Nassau County can result in up to one year in jail, probation, fines, community service, and a permanent criminal record. Class A misdemeanors (like assault, petit larceny, and criminal possession of a controlled substance) carry the most serious penalties. Class B misdemeanors carry up to 90 days in jail. But jail time isn't automatic—many first-time offenders avoid jail entirely through skilled negotiation. I focus on getting charges reduced, securing alternative sentences like conditional discharges, or winning dismissals outright.

A: Almost never. The first plea offer is rarely the best offer you'll get. Prosecutors start high and expect negotiation. I've been dealing with Nassau County prosecutors for over 31 years, and I know how to negotiate better deals. Sometimes that means getting charges reduced. Sometimes it means getting jail time taken off the table. Sometimes it means securing an ACD or conditional discharge instead of a conviction. Don't accept the first offer without consulting an experienced defense attorney who knows the Nassau County system.

A: Stay calm, be polite to police, and immediately invoke your right to remain silent and your right to an attorney. Do not answer questions without a lawyer present, no matter how friendly the police seem. Do not consent to searches. Call me as soon as you can: (631) 903-3733. I'm available 24/7, and I respond quickly to arrest calls. The sooner I get involved, the better I can protect your rights and start building your defense.

A: Yes. Even a misdemeanor conviction creates a permanent criminal record that can affect employment, housing, professional licenses, immigration status, and background checks. Many people think misdemeanors are "no big deal," but they're wrong. A misdemeanor conviction follows you for life. I've represented clients charged with petit larceny, marijuana possession, assault, harassment, criminal mischief, and other misdemeanors in Nassau County. In many cases, I've gotten charges reduced to violations or dismissed entirely, leaving clients with no criminal record.
