Experienced Long Island Criminal Defense & DWI Attorney

When you’re facing criminal charges or a DWI arrest on Long Island, your freedom, your career, and your future are on the line. I’m Ed Palermo, and I’ve spent over 31 years defending people just like you in Nassau County, Suffolk County, and throughout Long Island—from Mineola to Riverhead to the Hamptons.

This isn’t knowledge you pick up in a few years. It comes from three decades of hands-on experience defending thousands of clients, building relationships with judges and prosecutors, and fighting for favorable outcomes in cases ranging from misdemeanors to serious felonies. I know which prosecutors negotiate, which judges are fair, and what actually works in each Long Island courthouse—whether you’re appearing in First District Court in Hempstead, Sixth District Court in Patchogue, or any of the town and village courts across Nassau and Suffolk counties.

Defending Criminal Cases Across All Long Island Courts

Whether you’re charged with assault, drug possession, robbery, weapons offenses, theft crimes, sex crimes, white collar offenses, domestic violence, or DWI, I provide aggressive defense backed by deep local court knowledge. I’ve tried cases and negotiated resolutions in every criminal courtroom on Long Island, from the busy arraignment parts in Central Islip to the East End justice courts in Montauk and Shelter Island.

My practice focuses exclusively on criminal defense and DWI cases throughout Nassau County, Suffolk County, and the Hamptons. I handle everything from misdemeanor charges that can result in a criminal record to serious felonies carrying significant prison time. Every case gets my personal attention—I don’t hand your defense off to junior attorneys or paralegals. When you hire me, you get me in court, at every appearance, fighting for your rights.

Why Local Court Experience Matters on Long Island

Nassau County and Suffolk County operate very differently. Nassau has a centralized court system with high-volume courtrooms where cases move quickly and prosecutors handle hundreds of files. Suffolk County is more decentralized, with courtrooms spread across Riverhead, Central Islip, and dozens of town and village courts where local relationships and knowledge of individual judges matter tremendously. The Hamptons add another layer of complexity, with seasonal enforcement priorities and courts that see everything from local cases to high-profile arrests.

I know these differences because I practice in all of them, every single week. I know which Nassau County prosecutors will negotiate aggressively on drug cases and which Suffolk County judges give fair consideration to mitigation arguments. I know which town courts in the Hamptons move quickly and which require more strategic patience. This knowledge can mean the difference between a favorable plea deal and an unfavorable trial outcome, between a dismissed charge and a permanent criminal record.

What to Expect When You Hire Me

From the moment you call, you’ll work directly with me—not an intake coordinator or case manager. I’ll review the charges, the police reports, and any evidence the prosecution has. We’ll discuss your options honestly, including the strengths and weaknesses of your case. I’ll explain what happens at each court appearance, what the prosecution needs to prove, and what defenses we can raise.

Then we get to work. That means filing motions to suppress evidence when police violated your rights, challenging witness credibility, negotiating with prosecutors for reduced charges or dismissals, and preparing for trial if that’s the best option. I’ve handled thousands of criminal cases on Long Island, and I bring that experience to every new client.

Efficient New York Criminal Defense Lawyer

Ed Palermo is a seasoned Long Island criminal defense attorney with more than 31 years of experience representing individuals facing serious charges across Nassau and Suffolk counties. He personally oversees every case from the initial arrest through resolution, ensuring that no detail is overlooked and no client is treated like a file number. Over the course of his career, Ed has defended thousands of cases throughout Long Island, protecting clients against aggressive prosecutors and high-stakes criminal allegations. His practice is built on standing between his clients and a system that can move quickly—and harshly—against them. If you or a loved one is facing criminal charges on Long Island and needs clear, experienced legal guidance, Ed Palermo offers confidential consultations to discuss your situation and next steps.

Ed understands that criminal charges often come with immediate stress and practical challenges. When appropriate, he can arrange meetings that accommodate your circumstances, including hospital or in-home consultations throughout Long Island. He also understands that legal costs should not add to the pressure of an already overwhelming situation, and he works transparently with clients when discussing representation and strategy.

Trial-Ready Criminal Defense Strategy

While many criminal cases are resolved before trial, effective defense requires preparation as if trial is inevitable. Some defense attorneys rely too heavily on early negotiations without fully building their case, which can weaken their position with prosecutors. Ed Palermo takes a different approach. Every case is prepared with the expectation that it may go before a judge or jury. This trial-ready mindset strengthens negotiations, exposes weaknesses in the prosecution’s case, and positions clients for the best possible outcome—whether through dismissal, reduction of charges, or trial defense.

Focused Exclusively on Criminal Defense

Effective criminal defense demands focus, precision, and deep familiarity with the law and local courts. Ed Palermo concentrates his practice exclusively on criminal defense, representing clients in matters ranging from misdemeanors to serious felony charges. He does not represent the government, insurance companies, or institutional interests—his work is dedicated solely to defending individuals. This singular focus allows him to anticipate prosecutorial tactics, navigate local court procedures, and build defense strategies tailored to each client’s circumstances. At the core of his practice is a commitment to protecting his clients’ rights, freedom, and future.

Common Criminal Charges I Defend on Long Island

Over three decades, I’ve defended Long Islanders facing every type of criminal charge. That includes violent crimes like assault, robbery, and menacing. Drug offenses ranging from simple possession to intent to sell. Theft crimes including larceny, shoplifting, burglary, and credit card fraud. Weapons charges under New York’s strict firearms laws. Sex crimes including sexual assault, child pornography possession, and failure to register as a sex offender. White collar offenses like embezzlement, insurance fraud, and identity theft. Domestic violence cases including criminal contempt and violation of orders of protection.

Each charge carries different penalties, different defense strategies, and different opportunities for negotiation or trial. Some misdemeanors can be resolved with adjournments in contemplation of dismissal that leave you with no criminal record. Some felonies require aggressive pretrial motion practice to suppress evidence or challenge witness credibility. I’ve handled all of it, in every Long Island courthouse, for more than 31 years.

The First 48 Hours After Arrest Are Critical

What you do in the first two days after a criminal arrest can dramatically affect the outcome of your case. If you’re arrested and questioned, anything you say to police can be used against you—even statements you think are helpful or explanations you believe will clear things up. You have the right to remain silent and the right to an attorney, and you should exercise both rights immediately.

Once you’re arraigned, the court will set bail or release you on your own recognizance. The prosecution will begin gathering evidence, interviewing witnesses, and building their case. This is when I start building your defense—reviewing the arrest report, identifying Fourth Amendment issues, requesting discovery under New York’s criminal procedure law, and filing early motions when appropriate. The sooner you call me, the more time I have to protect your rights and start working toward the best possible outcome.

Don’t wait. Don’t talk to police without a lawyer. Don’t assume the charges will just go away. Call me at (631) 903-3733 as soon as possible, day or night. I’m available 24/7 because I know criminal cases don’t happen on a 9-to-5 schedule.

FREQUENTLY ASKED QUESTIONS

Legal fees vary based on the complexity and seriousness of your charges. Simple misdemeanors typically cost $2,500-$5,000, while serious felonies or aggravated DWI cases requiring extensive trial preparation can range from $7,500-$25,000 or more. Most attorneys offer free initial consultations to discuss your case and provide transparent pricing. When your freedom is on the line, investing in experienced local representation is one of the most important decisions you can make.

No. Exercise your right to remain silent and ask for an attorney immediately. Say clearly: "I am invoking my right to remain silent. I want to speak to my lawyer." Do not answer questions, explain your side of the story, or think you can talk your way out of the situation. Anything you say can and will be used against you in court, whether you're facing DWI charges or other criminal allegations.

Yes. Charges can be dismissed or reduced for many reasons, including insufficient evidence, constitutional violations (illegal search, Miranda violations), witness credibility issues, unreliable breathalyzer results, procedural errors, or successful completion of diversion programs. An experienced attorney will review every detail of your case to identify weaknesses in the prosecution's case and negotiate the best possible outcome.

Your first appearance is the arraignment, which typically occurs within 24 hours of arrest. The judge will inform you of the charges, ask for your plea (typically "not guilty"), and address bail or release conditions. In DWI cases, your license may be suspended immediately. In domestic violence cases, an Order of Protection may be issued. Having an experienced attorney at your arraignment can make a significant difference in whether you're released and what conditions are imposed.

It depends on the complexity of the case and whether it goes to trial. Simple misdemeanors may be resolved in 2-4 months. DWI cases typically resolve within 3-6 months. Felony cases can take 6 months to over a year, especially if going to trial. The timeline depends on court scheduling, whether you're in custody, the complexity of discovery, and whether the case goes to trial.

This is one of the most important decisions you'll make in your case. You need to consider the strength of the prosecution's evidence, potential plea benefits (reduced charges, lighter sentencing), and long-term consequences of a conviction (professional licenses, immigration status, employment). An experienced attorney can guide you through this decision, leveraging decades of experience to assess the evidence, negotiate favorable plea offers, or fight for an acquittal at trial, ensuring a strategy tailored to your unique circumstances.

Nassau and Suffolk are completely separate systems. Each has its own District Attorney's office with different practices and guidelines. Nassau County tends to be more aggressive, especially on felony matters, due to concerns about cross-border crime from NYC. Suffolk County covers a larger area and Central Islip is the busiest courthouse in New York State. You need an attorney who knows both systems and understands how prosecutors and judges operate in each jurisdiction.

Your license will typically be suspended at arraignment pending the outcome of your case. However, you may be eligible for a conditional license that allows you to drive to work, school, and medical appointments. If you refused the chemical test, you face automatic one-year license revocation regardless of whether you are eventually convicted of DWI. You have only 15 days to request a DMV refusal hearing to challenge this administrative penalty. An experienced DWI lawyer can help you understand your options and fight to protect your driving privileges.

Ed Palermo has over 31 years of experience exclusively practicing criminal defense and DWI law on Long Island. He's been voted Best Lawyer on Long Island six of the last seven years (2019-2026), has deep relationships with prosecutors and judges in both Nassau and Suffolk counties, and provides 24/7 direct access to clients via his personal cell phone. When you hire Ed, you get Ed—not a junior associate. He's tried everything from murder cases to DWI cases and has an excellent track record both negotiating and trying cases throughout Long Island.
