- Ed Palermo
Westhampton Beach DWI Lawyer
If you have been arrested for DWI in Westhampton Beach, you need an experienced DWI defense attorney who knows the Southampton Town Justice Court and understands the enforcement patterns in this gateway community to the Hamptons. I am Ed Palermo, and I have spent over 30 years defending DWI cases.
Westhampton Beach sits at the edge of the Hamptons, with its own police department and cases heard at Southampton Town Justice Court. The village’s restaurants, beach clubs, and nightlife create opportunities for DWI enforcement, particularly during summer months when the population swells with visitors.
DWI enforcement is active along Montauk Highway, the village’s main roads, and near popular destinations. The proximity to major roadways means that both Westhampton Beach Police and Suffolk County Police conduct DWI patrols. Whether you are a year-round resident or a visitor, a DWI charge requires immediate attention.

Why Choose Ed Palermo as Your Westhampton Beach DWI Lawyer?
When facing a DWI charge in Westhampton Beach, you need more than just a lawyer — you need an advocate who understands the science behind DWI cases, the local court system, and how to fight for the best possible outcome. I am Edward Palermo, a DWI defense attorney with over 30 years of experience defending Long Islanders charged with impaired driving.
I have handled every type of DWI case — from first offense DWAI to aggravated DWI to felony DWI — earning a perfect 10 “Superb” rating from AVVO and recognition as a New York Law Journal Trailblazer. I have secured dismissals, reductions to non-criminal traffic infractions, and not guilty verdicts in DWI cases throughout Long Island.

FREQUENTLY ASKED QUESTIONS
Can I lose my license after a DWI arrest in Westhampton Beach?
Yes. Your license can be suspended at arraignment and again if convicted. Refusing a chemical test triggers an automatic one-year revocation through the DMV, separate from criminal penalties. I fight to protect your driving privileges at both criminal court and DMV hearings simultaneously.
Where will my Westhampton Beach DWI case be heard?
DWI arrests within the village are heard at Westhampton Beach Village Justice Court at 165 Mill Road, Lower Level — typically Wednesdays at 1:00 PM. Arrests outside village limits go to Southampton Town Justice Court in Hampton Bays. Felony DWI charges may be transferred to Suffolk County Court in Riverhead.
How long does a DWI stay on my record in New York?
A DWI conviction remains on your criminal record permanently unless eligible for sealing. On your driving record, a DWI counts as a "prior" for 10 years — a second DWI within 10 years becomes a felony. I work to avoid convictions or negotiate reductions that minimize long-term impact.
I was arrested for DWI in Westhampton Beach but live out of state. What should I do?
This is common, especially during summer. I can handle most court appearances on your behalf so you do not need to travel back to New York repeatedly. Contact me immediately so all deadlines — including the DMV refusal hearing deadline — are met.
Should I plead guilty to a DWI in Westhampton Beach?
Almost never without consulting an experienced DWI attorney first. Many DWI cases have viable defenses — illegal stops, improperly administered field sobriety tests, uncalibrated breath testing equipment, procedural violations. Even when evidence seems strong, I can often negotiate a reduction. Free consultation available.
